Section 409-d of the (New York State) Education Law, as added by Chapter 466 of the Laws of 1992, requires that all school districts and BOCES conduct annual visual structural inspections of all instructional buildings owned by the district pursuant to Section 155.1 (d) of the Regulations of the Commissioner of Education by June 30, of each year. The visual inspections shall be conducted by a team composed of the director of facilities or equivalent, the building's custodian or equivalent and a code enforcement official. The Safety Office will provide the trained codes enforcement official to complete the inspection team, along with the complete documentation of the inspection team's findings. The inspection team's findings must be submitted to the local board of education for its approval and then the public must be notified that the inspection has taken place in their district. The Safety Office will present the inspection to the local board of education if requested by the district superintendent and will assist in the notification process. If the inspection team recommends that a further in-depth investigation be conducted by a licensed engineer or architect, the Health and Safety Service will assist in securing these services. This program is part of the Health and Safety Service.
